Influencer marketing is covered under Australian and New Zealand advertising laws, so it’s important that any time you receive payment, free product, or another incentive from us, you make that clear in your content. This guide gives you a simple rundown of what’s required, why it matters, and how to disclose properly when you collaborate with Wahl.
Australian Legal Overview
Influencer marketing in Australia is regulated under the Competition and Consumer Act 2010 (Cth), specifically Schedule 2: Australian Consumer Law (ACL). These laws apply to anyone promoting products or services in exchange for payment or value, including gifted items.
Two key sections apply directly to influencer content:
Section 18 – Misleading or Deceptive Conduct
You must not, in trade or commerce, engage in conduct that is misleading or deceptive or likely to mislead or deceive.
In plain English: Always make it clear when you’ve been paid or gifted something.
Section 29 – False or Misleading Representations
You must not make false or misleading claims about a product, its quality, value, or benefits, and you can’t imply sponsorship or approval that doesn’t exist.
In plain English: Only make genuine claims and be upfront that it’s a collaboration.

New Zealand Legal Overview
In New Zealand, influencer content is governed by the Advertising Standards Authority (ASA). Their guidelines make it clear that sponsored or gifted content must always be disclosed so audiences can easily identify advertising.

How to Disclose Correctly
Whether you’ve been paid, gifted, or offered an incentive, make sure your audience knows. Here are a few simple ways to stay compliant:
- Include a clear hashtag like #ad, #sponsored, #paidpartnership, or #gifted at the start or within the first few lines of your caption.
- If you’re posting Stories or short-form videos, include the disclosure on-screen and verbally where possible.
- Make sure your disclosure is easy to read, visible, and unambiguous. Don’t hide it in the middle of a tag cloud.
Examples
- Instagram Reel: “Loved creating this look with my new Wahl Product! #ad #gifted @WahlANZ”
- Story: Add #sponsored or #gifted or #ad tagging Wahl’s handle clearly on-screen.
- YouTube video: Mention verbally and in the description that it’s a collaboration with Wahl.
